TERMS OF USAGE PlentyLeads SaaS Platform
1. GENERAL PROVISIONS
1.1 This Terms of Usage Agreement (the “Agreement”) governs the use of the PlentyLeads SaaS platform (the “Platform”).
1.2 By creating an account, using the Platform, or making a payment, the User confirms that they have read, understood, and agreed to this Agreement. If the User does not agree with the terms, they must stop using the Platform.
2. PLATFORM DESCRIPTION
2.1 PlentyLeads is a SaaS platform that provides tools for: automating lead generation; creating and managing outbound campaigns; sending messages; analytics and response processing; integration with third-party services (email providers, CRM, API, etc.).
2.2 PlentyLeads provides access to software, not lead generation services.
3. NO AGENCY OR CONSULTING OBLIGATIONS
3.1 PlentyLeads: is not an agency; does not act as a representative of the User; does not provide marketing, consulting, or brokerage services.
3.2 All actions, decisions, and settings within the Platform are the sole responsibility of the User.
4. REGISTRATION AND ACCOUNT
4.1 Users must create an account and provide accurate information to use the Platform.
4.2 Users are fully responsible for: maintaining the security of login credentials; all actions performed through their account.
4.3 PlentyLeads may suspend or terminate account access if: the Agreement is violated; illegal activity occurs; Platform functionality is abused.
5. PAYMENT AND ACCESS
5.1 Access is provided via subscription or one-time payment per the selected plan.
5.2 Payment is made in advance.
5.3 Refunds are governed by the separate Refund Policy posted on the website.
6. NO PERFORMANCE GUARANTEES
6.1 PlentyLeads does not guarantee: any specific number of leads, replies, or deals; revenue growth or conversion improvements; any particular business outcomes.
6.2 The Platform is provided “as is”.
7. USER RESPONSIBILITY
7.1 Users are responsible for: compliance with applicable laws (including anti-spam, GDPR, CAN-SPAM, etc.); content of messages; processing third-party personal data; consequences of using the Platform.
7.2 PlentyLeads does not monitor or moderate user content.
8. LIMITATION OF LIABILITY
8.1 PlentyLeads is not liable for: direct or indirect damages; lost profits; data loss; account suspension on third-party platforms; actions or failures of third-party services.
8.2 Total liability is limited to the amount actually paid by the User for the last billing period.
9. THIRD-PARTY SERVICES
9.1 The Platform may integrate with third-party services.
9.2 PlentyLeads: does not control them; is not responsible for their availability, changes, or policies.
10. INTELLECTUAL PROPERTY
10.1 All rights to: software code, interface, texts, Platform logic belong to PlentyLeads. Users are granted a limited, non-exclusive license to use the Platform under this Agreement.
11. TERMINATION
11.1 PlentyLeads may suspend or terminate access and delete accounts for breach of this Agreement without compensation.
12. CHANGES TO THE AGREEMENT
12.1 PlentyLeads may modify this Agreement at any time.
12.2 The current version is published on the website and becomes effective immediately.
13. GOVERNING LAW
13.1 This Agreement is governed by the laws of Spain.
